TASTETHEBLUE LTD TERMS OF BUSINESS - TRAINING, INSTRUCTOR PROVISION, SKIPPER & RACE CREW

CONTRACT

Your contract is with tastetheblue Ltd (the Company). When you sign the booking form/indicate acceptance of our quote in writing (e-mail or message) and/or make the deposit payment you are accepting these conditions. Acceptance of a quote using our online system also indicates acceptance of these conditions. The booking agreement becomes binding once signed by you and confirmed in writing or by email by the Company. Deposits are non-refundable.

BOOKING

On confirmation of availability, please ensure you provide a written confirmation of intent. Booking is secured when we have acknowledged your confirmation of intent. All confirmed bookings will receive booking confirmation and joining instructions. Payment in full must be received and cleared 6 weeks prior to the start of the course or event unless otherwise agreed. Bookings made within 6 weeks of the start date should be paid in full. All relevant parts of the booking form must be completed by all participants at the time of booking along with the onshore contacts and medical declaration forms.

The cost of shorebased tuition includes certification, RYA course materials as directed by them, and instructor time. For public courses a classroom with basic refreshments and facilities will be provided. For private training additional expenses will be agreed and discussed in advance, and it is the responsibility of the client to provide appropriate facilities and learning spaces.

Prices for instructors (including own boat tuition), race crew, and skippers/mates are based on a reasonable working day, and do not include any expenses or subsistence.

No guarantee is made as to the destinations, performance/results, and/or timings due to the nature of boating, and no liability is accepted for additional expenses that may be incurred. No animals, plants, restricted items or illegal goods are to be brought onboard the yacht. Individuals who compromise this will be in breach of contract and may be requested to leave the vessel.

At all times whether trade or private customers vessels should carry their own insurance appropriate to the intended operation, and this should include risks to our staff/crew. In the event we are undertaking training on board we recommend you advise your insurance company of this. Unless expressly stated the owner/operator will remain the skipper and responsible party for any vessel we have staff on board, and our instructors/race crew will act in a purely advisory capacity. No liability is accepted or implied to tastetheblue ltd whether or not our instructor or crew’s advice is followed.

In the event we are supplying a skipper they must be covered by the vessels insurance. Instructors supplied to RYA Training centres must be covered by that centre’s policy. The limit of our liability shall be 0.

AGE LIMITS

The Company cannot accept clients under the age of 18 unless accompanied by a parent or legal guardian and agreed in advance.

CANCELLATION

The Company has the right to cancel the booking due to circumstances beyond its control. Alternative dates will be offered or a full refund of all fees paid. The Company will not accept liability for any incidental expenses incurred in the event of a vessel not being able to return to port, or any other agreed destination on time due to weather, equipment failure or any other circumstances. Clients may elect to stay with the yacht at no extra charge, or make their own alternative arrangements to return at their own expense. If you have to cancel a confirmed booking please do so in writing or by email at the earliest opportunity. Clients will be liable for the full course fee if a booking is cancelled within 6 weeks of the start date of the course or event. No refund or part refund can be offered if a client leaves the vessel prior to completion or the event is cancelled midway. This includes races that are postponed or delayed.

INSURANCE

Any vessel provided by the Company will conform to the Department of Transport (DoT)/Marine Coastguard Agency (MCA) Code of Practice for Small Commercial Vessels. It will be fully insured against accident, third party liability and personal injury arising from negligence by the Company. However, the Company accepts no liability for personal accident or loss or damage to property belonging to the Client. Clients participate in all courses/activities at their own risk and are advised to take out the appropriate insurance to cover these eventualities and cancellation charges.

Where instructors, skippers, race crew or other crew are supplied by the company, any vessel should hold it’s own insurance covering accident, third party liability and personal injury. We recommend owners advise their insurance company when any own boat tuition is taking place (i.e. one of our instructors is invited on board). These such vessels should be fully found, seaworthy, and appropriately maintained. Where relevant they should comply with SOLAS regulations, Coding, provisions of a race authority, RYA guidance notes for recognition, or be equipped according to the RYA Boat Safety handbook.

INSTRUCTOR/SKIPPERS AUTHORITY

Decisions made by the Skipper/Instructor are final in respect of the safety of any company supplied vessel and the welfare of the crew.

Where instructors or race crew are on board privately owned vessels they are acting in a purely advisory role, and responsibility rests with the designated skipper.

HEALTH & SAFETY

Boating is an activity sport and it is the responsibility of the Client to ensure they are fit and healthy to go afloat. Please consult with your GP if there is any doubt. If you are taking any form of medication please bring double the amount so that the Skipper can hold a reserve.

COMPLAINTS

Should you wish to make a complaint please make the Company aware at the earliest possible time. We would like the opportunity to deal with any issues as they arise so we can rectify them immediately.
